Terms of Use of Real Estate MapBuilder Service

Thank you for using the Real Estate MapBuilder! By using the Real Estate MapBuilder (the "Service"), you ("You") accept and agree to be bound by the following terms and conditions (the "Terms of Use").

   1. Service.

      1.1 Description of Service. The Service consists of Javascript, HTML, communication protocols that allows You to display Real Estate Listings on your website(Front End) and Real Estate management interface tied with MapBuilder.net(Back End). 

      1.2 Front End Interface. Front End Interface is used directly on your server and you agree to use it only with valid Service subscription. You have right to modify JavaSCript/HTML source code of the Front End Interface. You may not, nor may you allow others to use Front End interface once your service subscription or trial period expire. You may not, nor may you allow others to, sell, lease or otherwise re-distribute Front End Interface provided for you as a part of Service.

      1.3 Back End Interface. Back End Interface is a special add-on on MapBuilder.net which provides Property managements functionality. Access to that add-on might be granted to you for free for trial period or based on monthly subscription fee.

      1.4 You agree to use the Service only for purposes that are legal, proper and in accordance with these Terms of Use and any applicable policies or guidelines. You agree that when using the Service, You will not:
          * upload, post, email or transmit or otherwise make available any inappropriate or unlawful Content;
          * upload, post, email or transmit or otherwise make available any Content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party, unless You are the owner of the Rights or have the permission of the owner to post such Content;
          * use MapBuilder.net services for any illegal or unauthorized purpose;
          * remove any copyright, trademark or other proprietary rights notices contained in or on Real Estate MapBuilder services;


   2. Proprietary Rights.

      2.1 MapBuilder.net Rights. You acknowledge that MapBuilder.net owns all right, title and interest, including without limitation all Intellectual Property Rights, in and to the Service and that You shall not acquire any right, title, or interest in or to the Service, except as expressly set forth in the Terms of Use.
      2.2. You own all right to the content uploaded to MapBuilder.net.


      3. DISCLAIMER OF WARRANTIES

      YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

      a. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MAPBUILDER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

      b. MAPBUILDER.NET MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

      c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

      d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MAPBUILDER.NET OR THROUGH OR FROM MAPBUILDER.NET SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.
   
      4. LIMITATION OF LIABILITY

      YOU EXPRESSLY UNDERSTAND AND AGREE THAT MAPBUILDER.NET SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MAPBUILDER.NET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
      
      5. EXCLUSIONS AND LIMITATIONS

      SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 5 AND 6 MAY NOT APPLY TO YOU.
      
      6. Termination.
      MapBuilder.Net may change, suspend or discontinue all or any aspect of the Service, including their availability, at any time.
